Statutory Employee Benefits

Statutory employee benefits are the benefits Indian law requires employers to provide, such as provident fund, ESI, gratuity and maternity benefit.

What are statutory employee benefits?

Statutory employee benefits are the benefits that employers in India must provide by law, as opposed to voluntary benefits they choose to offer. Which ones apply depends on factors such as the type of establishment, its location, the number of employees and individual wage levels.

Commonly applicable statutory benefits include:

Benefit Purpose
Employees' Provident Fund (EPF) and pension Retirement savings and pension, with contributions from employer and employee
Employees' State Insurance (ESI) Medical care and cash benefits for eligible lower-wage employees
Gratuity A lump sum paid on leaving after a qualifying period of service
Maternity benefit Paid maternity leave and related protections
Employee's compensation Compensation for work-related injury, disease or death
Statutory bonus Annual bonus for eligible employees in covered establishments
Leave and holidays As set by central and state laws, including shops and establishments laws

Health and safety duties, such as medical examinations for certain workers, also arise under the OSH Code, 2020 and factory rules.

India's four labour codes, including the Code on Social Security, 2020, consolidate many of these laws and change some definitions, such as how "wages" are calculated. Implementation depends on central and state rules, some of which are still being finalised, so employers should confirm what applies with counsel or a compliance adviser.

Why it matters for employers

Statutory benefits are non-negotiable. Missing registrations, late contributions or incomplete records can lead to penalties and employee grievances. But compliance alone rarely meets employees' real health needs. For example:

That is why many employers build voluntary benefits, such as checkups, OPD cover and counselling, on top of the statutory base.

Example

A growing startup crosses the employee thresholds for several laws in the same year. HR works with a compliance adviser to register for EPF and ESI, update appointment letters and set up gratuity provisioning. At the same time, it adds group health insurance and annual health checkups so employees above the ESI ceiling also have health cover.
